Nintendo of America is suing the United States government over the sweeping tariffs President Donald Trump put in place last year, according to a complaint filed Friday in the U.S. Court of International Trade and obtained by Aftermath. Though the Supreme Court has stymied the tariffs for the time being, the situation remains in flux for companies manufacturing goods outside the U.S. and sent stateside.



Important to note that many companies are suing, Nintendo is not uniquely taking on the government.
Given recent rulings, it seems like not suing right now might be equivalent to giving up free money. Why not ask for what you’re owed?
Sad thing is all these companies near certainly passed most of the costs onto consumers, and consumers almost certainly will see none of the refunds.
Nintendo explicitly said they did. They opted not to increase the asking price of the Switch 2 but did increase the prices of the Switch 1 and accessories of both consoles to compensate.

No way any customers see refunds from that. I doubt there will even be price reductions with the tariffs no longer in place.
FWIW, Nintendo didn’t (because they got a bunch of Switch 2s into America before tariffs came into force).
