What is a “basic law”? Kinda relies on some wacky assumptions like “natural law”. In reality it’s just whatever the state says and the state will never prosecute itself.
Functionally the judicial being separate from the executive does enable the state to prosecute itself based on laws passed by the legislative. It happens kind of regularly actually just not at the federal level where it’s really needed right now.
