I knew a guy who was drunk and “sure” a gun wasn’t loaded, so he pointed it his riends head, and blew his brains out.
When I lost touch, he had been waiting for the civilian court case for almost a year and still in the military, but they were making his life hell in the meantime.
They were just waiting on the civilian ruling before doing their own and sending him to Leavenworth for it.
They can order prison though.

This was civilian court. He hasn’t been tried in a court martial yet.
He’ll be heading to Leavenworth shortly. The military always lets civilian courts go first, specifically to ensure that service members don’t get off lightly.
This is like the $150 fine that the Commonwealth of KY will fine you if you detonate a nuclear device within city limits. They’re just getting the pennies they think they might get out of you when the federal government is done with you.
I think it’s five years later you can appeal, and almost all of them get approved.
Like, if you got a DUI or popped on a drug test, you can probably get it changed. It’s a small hassle, but there’s no reason not to fill out the paperwork

The court martial he’s going to have is entirely separate from civilian legal proceedings. And I expect the presiding officers are going to absolutely throw the book at him, if for no other reason than to set a graphic example.
And if they don’t, we’ll know a bit more about the dangerous personal politics of some officers in the Marines.
Yeah, this is what gives me the cold sweats. Enlisted guys being conservative and following the Republican line to the extreme? Not a damn surprise there, been that way as long as I remember. Officers, especially upper ranks, being that way enlisted guys are? That’s scary.
I just hope there’s enough people in our military leadership who will channel the spirit of General Smedley Butler, who blew open and helped to kill the business plot back in the 1930s.
I’m so hype to see what military courts have to say about openly advocating for a second civil war.
Article 94 of the UCMJ is pretty clear. He’s looking execution if they decide we were at war at the time, and life in Leavenworth otherwise.
I am too. And I hope it amounts to “don’t fucking do that”.

In many countries, an active duty soldier commiting treason will result in a firing squad.
Now that he’s been found guilty, I hope that he receives a dishonorable discharge.
No double jeopardy with the UCMJ…
It’s entirely possible he still ends up in Leavenworth, which would 100% be worse than normal jail.
They’ll discharge them after a stay in Leavenworth. The military judicial system has not yet had its turn.

This was the civilian court’s decision. Now that it’s over they’ll face the military court.
I’m confused. Why did the judge use such a weird frame of reference for the sentence? How can you use casualties from one branch of the military, in a war over a century ago, for a case today? Seems entirely arbitrary and out of context.
Like, we don’t sentence thieves in 2023 based on how many boxes of tea were destroyed during the Boston Tea Party.
Can they at least make him eat a whole box of crayons? One of the 250 in a box ones?

Being in the Marines is punishment enough most of the time
The Marines I know don’t seem to mind at all, they relish it.
Have they been to war yet tho? Have they seen their squadmates dead bodies?
I was Navy and on a marine transport ship. The ones who hadn’t been deployed yet were gunho and annoying as shit. Like young puppies.
The ones who had actually seen shit, were a lot more rational and disillusioned.
Don’t underestimate the brainwashing of the military, especially for exclusive stuff, it takes a while to get that out of your head after training.
The Marines I know that saw combat are often messed up with PTSD and feel lost without their units, but still seem very proud to have been Marines.
